Liability Waiver

Yoga Universe, LLC, doing business as Mindful Owl Yoga (“Mindful Owl”), 11517 Highway 92, Suite 113, Woodstock, GA 30188.

Please read this carefully. By accepting it, you give up certain legal rights, including the right to sue Mindful Owl for injuries caused by its ordinary negligence.

1. Voluntary participation

I choose to take part in classes, workshops, events, teacher trainings and any other activities offered by Mindful Owl, at the studio or elsewhere (“Activities”). I do so voluntarily and at my own risk.

2. Risks I understand and accept

Yoga and movement involve physical effort and can cause injury, including strains, sprains, falls and the worsening of existing conditions. Specific risks include:

  • Heated classes. Practicing in a heated room can cause dehydration, dizziness, heat exhaustion or heat stroke. I will hydrate, rest when needed and leave the room if I feel unwell.
  • Equipment. Weights, balls, bands, props and red light therapy mats can cause injury if misused. I will follow the teacher’s instructions.
  • Hands-on assists. Teachers may offer hands-on adjustments. I can decline at any time by telling my teacher.
  • Off-site events. Hikes, outdoor classes and other off-site events carry added risks, including uneven terrain, weather, insects and travel to and from the location.

3. My health

I am responsible for consulting a physician before taking part. I will tell my teacher about any injury, illness, pregnancy or medical condition that could affect my practice, including heart conditions, high or low blood pressure, diabetes, asthma, epilepsy or recent surgery. I will practice within my own limits and stop if I feel pain, dizziness or discomfort.

4. Studio rules

I will follow Mindful Owl’s posted and stated policies, including the Studio Policies, and the instructions of its staff.

5. Release and waiver

To the fullest extent permitted by law, I release, waive and agree not to sue Mindful Owl and its owners, members, employees, instructors, independent contractors and volunteers (the “Released Parties”) for any injury, illness, death, loss or damage arising from my participation in the Activities or my presence at the studio, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. This release does not cover gross negligence or willful misconduct.

6. Indemnity

I will cover the Released Parties’ costs, including reasonable attorney fees, for claims brought by me or on my behalf that this waiver releases.

7. Who this binds

This waiver binds me, my heirs, executors, administrators and anyone claiming through me.

8. Photos and video

Mindful Owl may photograph or film classes and events and use those images to promote the studio, without payment to me. If I don’t want to appear, I will tell the teacher or front desk before class.

9. Minors

For anyone under 18, a parent or legal guardian must accept this waiver on the minor’s behalf and is responsible for the minor’s participation. Students under 16 must practice with a parent or guardian in the room.

10. General

This waiver stays in effect for all future visits until Mindful Owl posts a new version. Georgia law governs it. If any part is found unenforceable, the rest still applies.

I have read this waiver, understand that I am giving up legal rights, and accept it voluntarily.
